Hello and thanks for using HeartsBridges, the unique mobile application that let you lock your love within virtual love locks on real love bridges by using the power of Augmented Reality (referred to as the Service and Application).

 

MIRAD GLOBAL SRL (hereafter referred to as Company) is dedicated to protecting the privacy of our users and handling any personal data we obtain from our users with care and respect. An overall principle is that we do not collect more information than is reasonably necessary to provide you with the best user experience. Company may use affiliates’ or reputable third parties’ services for the processing of personal data collected on or through the Service.

Downloading, signing up, accessing or otherwise using HeartsBridges Application by you, including all associated features and functionalities, websites, social media sites and user interfaces, as well as all content and software associated with the Service is subject to our Terms of Service, this Privacy Policy and any other terms referenced in these documents and indicates your full consent to them.

The Service (including the Application) is licensed and available for download against payment through 3rd party stores, such as Apple App Store and Google Play Store. The Service does not pop-up adverts.

 

  1. About this Privacy Policy

This privacy policy (referred to as Privacy Policy) explains how information about you is collected, used, stored and disclosed when you download, sign up, access and use our HeartsBridges Application, and which are your rights related to this information. You should make sure therefore that you read this Privacy Policy, our Terms of Service and any other terms referenced in these documents carefully before using the application. This Privacy Policy is applicable exclusively where Company acts as a data controller with respect to your data. This is the case where we determine the purposes and the means of the data processing in our Service.

The Privacy Policy applies in addition to our Terms of Service and other policies. In the case of a contradiction between our Terms of Service and this Privacy Policy, this Privacy Policy will prevail. This Privacy Policy does not apply to the practices of companies we don't own or control, or people that we don't manage.

By downloading, accessing or using the Service, you acknowledge and agree that we will collect, use, store and disclose your information as described in this Privacy Policy. You have choices about whether to provide us with information and how we use that information. You may choose not to provide us with information, but your choice(s) may prevent you from accessing or using the Service.

We're constantly trying to improve our Service, so we may need to update this Privacy Policy. We may update this Privacy Policy to reflect changes in the law, in the Service, in the Company or advances in technology. The most recent version of these Privacy Policy shall at all times be accessible via the application in your Account Settings as well as on our websites. We can also alert you about changes in the Privacy Policy by sending you an email. Our use of the information we collect is subject to the Privacy Policy in effect at the time such information is used.

This Privacy Policy does not apply to any information that you share in the public places of the Service or through a public feature of our Service.

The rules in the European Union for how the personal data of individuals may be collected, stored and used changed on 25th May 2018, when the General Data Protection Regulation (GDPR) came into effect. These rules apply to all companies, wherever they are based, that process personal data about citizens in the EU and other countries in the EEA. The regulation will also continue to apply in the UK after it leaves the EU. We are fully committed to complying with the new rules, and to protecting the rights of all people who give us their data, wherever in the world they may be.

  1. Information We Collect & Use

In this Privacy Policy, the term “personal data” means information you provide to us which personally identifies you, such as your name, email address, photos or your location or other data which can be reasonably linked to such information by us.

Some of the information we collect is provided by you, some is collected automatically (typically from devices) and some may be collected from other sources.

We do not sell your personal data – such as your name and contact information – to third parties to use for their own marketing purposes.

 

A.Information that you provide voluntarily

Certain parts of our Service may ask you to provide personal data voluntarily. For example, we may ask for certain information in order to register an account with us, use features in our Service, subscribe to marketing communications from us, and/or to submit enquiries to us, such as:

  • - your full name, email address, username, password, photo or other contact details or data,
  • - User Generated Content, including text, pictures, graphics or video, that you choose to make available in a virtual love lock to the public or to a specific group,
  • - any information you submit to us via email, feedback form or social media.

For using the Service after downloading and installing the Application, the User is requested to sign up for a User Account. For this, the User must enter his valid email address and a freely selectable and sufficiently secure password in the registration screen. Further data will be specified after creating the User Account. Please be aware that false, incorrect, or out-dated information may impact Company’s ability to provide you with the Service and to contact you when necessary.

We also collect your information when you use our Service, such as when you invite your beloved person to join you or you create and lock a virtual love lock or share a virtual love lock. Please note that when you decide to create and lock a virtual love lock with your beloved person, your both full name and the date of your virtual love lock will be visible to others irrespective of the selected lock status. Depending on the status you select for your virtual love lock, others could see your love message and love photo. If you don’t want to share such information, please choose the status „Private”. When you choose to upload a photo and select the status “Public” or “Shared” you gave your explicit consent to make this photo available to the public or to a specific group.

To properly use our Service, you may allow us to access your camera, photo library and location. Depending on your device, Apple and Android system will ask for your permission before allowing us to access these resources. You can revoke permissions for the Service to access these resources at any time. In this case, certain features of the Service may no longer be available or the functionality of the Service will be impacted as a whole.

You may choose to transmit and share personal information and User Generated Content on or through our Service with your contacts (such us Email, SMS, WhatsApp, etc.) or through your social network (such us Facebook, Instagram, Twitter, etc.). The communication or social network’s use of information made available by our Service is governed by that social network or provider privacy policy and controlled by the social network or provider, NOT by this Privacy Policy or by Company.

We may also collect your information when you use our Service such as when you upload data, request further services or make selections using our Service, if such functionality is available in the Service.

If you contact our support team or provide us with feedback, we collect the information you give us when you report a problem, contact or communicate with us.

From time to time, we may request your opinions, suggestions, or modification and improvement ideas (referred to as Feedback) through surveys, or other similar requests or based on your own initiative. Any responses you provide are voluntary, however you agree that any Feedback you provide to us shall be owned by Company and may be used by Company in our sole discretion and with no other obligations or payment.

 

B. Information we collect automatically

We collect information from and about the device(s) you use to access our Service, such as:

  • - geolocation data (in the form of GPS data), which is any information which indicates the geographical position of your device and which may include precise location data (e.g. the latitude and longitude of your mobile device and other additional attributes) as well as the date and time the location was recorded. The precision of latitude and longitude varies greatly and is determined by various factors including those controlled by your device, operating system, or mobile service provider.

We collect location information to provide you with a seamless Augmented Reality experience, provide advertisements or notifications that are relevant to your geographic location, and conduct analytics and optimization to improve the Service.

You can revoke location permissions for the Service at any time. Please be aware that the functional use of the Service: generating virtual love locks, successfully locking of virtual love locks or viewing virtual love locks on real bridges is dependent on the data related to your geographic location, and you acknowledge and agree that any failure to provide or make accessible that data will limit or make impossible the functionality of the Service as described above. We store location data when you generate and lock a virtual love lock on a real bridge.

  • - information in so-called server log files, which your device automatically transmits to us such as, but not limited to: date and time of the server request, time zone, browser type and version, operating system used, app version, referrer URL, error logs, and the IP address and device identifier.

The log files data is for data security, error analysis and improving system performance only. A merge of this data with other data sources will not be done. The server log files are automatically deleted after 60 days.

 

  1. Third-Party Application Distributor

The Company may also use third-party platforms, service providers or distributors (referred to as Third-Party Application Distributor), such as Apple App Store or Google Play Store, in order to sell the Application. The Third-Party Application Distributor acts as a data controller with regards to the personal data related to the transactions (“transaction data”) processed for the purpose of purchasing the Application. The transaction data may include your personal details, your payment card details, and other transaction details. Company do not have access to the personal data you provide to the Third-Party Application Distributor. The personal data you provide to the Third-Party Application Distributor is governed by the Usage Rules and Privacy Policies of the Third-Party Application Distributor. Analytics, Advertising & Technical Data

Analytics – We may use third-party Service Providers as Google Analytics, Facebook Analytics, Google Analytics for Firebase or other providers for measuring and understanding the Service usage, how individuals and their devices interact with our Service, for business and market research, and to assess and improve the functionality and performance of our Service. The privacy practices of these tools are subject to their own privacy policies. Please see Google Analytics Privacy Policy at: http://www.google.com/analytics/learn/privacy.html, Facebook Analytics Privacy Policy at: https://www.facebook.com/privacy/explanation and Google Analytics for Firebase at: https://firebase.google.com/support/privacy. The IP Anonymization for the Service is generally activated in Google Analytics. As a result, your IP address will be truncated by Google within member states of the European Union or other parties to the Agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there

Cookies and Related Technologies – When you access our websites or application we may use cookies, which are text files containing small amounts of information that are downloaded and stored on your device, or related technologies, such as web beacons, tags, local storage objects and tracking pixels, SDK’s or others to store or collect information (referred to as “Cookies”). Cookies do not harm your device and do not contain viruses. Cookies serve to make our offer more user-friendly, effective and secure. Cookies can help us learn about your online behaviour including on other sites or services and allow us the display of advertising and interest-based advertising or advertisement from selected third party.

You are free to delete or block cookies from your device, by changing the preferences on your browser or device. However, we cannot guarantee that our Service will fully operate should you choose not to accept cookies. Please check our Cookie Policy for more detailed information.

Ads for Products and Services – We may use services, like Google Ads, Google Ads Remarketing, Facebook Ads or Facebook Custom Audiences / Conversion ("Facebook Pixel") or Twitter Ads and Remarketing to serve tailored ads to you about the Service and Company. We may also support or allow the delivery of advertising for the products and services of other companies. Our third-party partners can use cookies to collect information about your activity within the websites, social media sites or application to provide you with such advertising as retargeting ads. They may also access and use unique device identifiers, such as IDFA. We do not have access to Cookies and related technologies placed or read by Advertisers, and this Privacy Policy does not govern the use of those cookies and related technologies placed by third parties. If you wish to opt out of interest-based tracking through your mobile device, you can do so through your device "settings", Privacy Settings–>Ads personalization. Please note that if you opt out through these settings, you will continue to receive advertising after you opt-out, but it may not be tailored to your interests.

APIs/SDKs – We may use third-party Application Program Interfaces (“APIs”) and Software Development Kits (“SDKs”) as part of the functionality of our Services. For more information about our use of APIs and SDKs, please contact us.

 

  1. Third-Party Content, Links, or Plugins.

The Service or our websites may have links to third-party websites, content, tools or applications which may have privacy policies that differ from our own. We are not responsible for the practices of such sites and the terms of this Privacy Policy do not apply to such third-party content.

The Service may also offer you the ability to interact with social media sites (Facebook, Instagram, Twitter, etc.) or other tools (Email, SMS, WhatsApp, etc), which let you share actions you take on our Service with other apps, sites, or media and which may allow us and/or the social media site to receive data from or about you. Your use of social network features and other related tools is subject to each social media site's privacy policy, which may be different from ours, so please read these social networks policies carefully to understand their policies and your options. As with linked sites, we have no control over the information that is collected, stored, used, or disclosed by social networks, and we are not responsible or liable for the practices of such sites.

We may include and make use of third-party plugins as part of the functionality of our Service (such as Google Maps and others). Plugins may allow third parties including analytics and advertising partners to collect your personal data for various purposes including to provide analytics services and content that is more relevant to you.   1. Other Sources

We may gather information, including demographic and statistical information from third parties, such as business partners, marketers, researchers, analysts. We may attribute this information to you based on your assignment to certain statistical groups. We may use this information to supplement the other information that we collect or analyse in order to derive your possible interests and to provide more relevant experiences for you within the Service and improve our products, analytics, and advertising.

We may also receive information from third party services about how Company’s own marketing efforts performed on third party sites or platforms.

We may use anonymous, statistical or aggregated information and may share it with our partners for legitimate business purposes. It has no effect on your privacy, because there is no reasonable way to extract data from the aggregated information that can be associated with you.

 

  1. Push Notifications

When you use the Service, you may receive push notifications. If you prefer not to receive push notifications, you may adjust your settings on your mobile device to control whether you want to receive these alerts. Users must be aware that disabling push notifications may negatively affect the utility of the Service.

 

  1. HTTPS or SSL/TSL Encryption

For securing the communication between the Service and our servers and to protect the transmission of sensitive content, such as passwords, we use HTTPS protocol based on SSL/TSL. If SSL or TLS encryption is enabled, the data you submit to us cannot be read by third parties.

 

  1. How we use information

The main reason, we collect, use and store (“process”) your information is to provide our Service, to fix and improve the Service, to manage the contract with you, to measure performance, to monitor the usage of our Service, to develop new features, to market our company and its products and services and to enforce the Terms of Service, Privacy Policy or other policies as well as when we have a legitimate interests (e.g. our interests in running our business, managing and providing you with better services, etc.), or to protect Company, our users or the public, or in accordance with legal requirements (for example, for tax, legal, regulatory, accounting or other purposes). Additionally, we may use your information to help keep you safe and to communicate with you.

We may disclose your information to third-parties: (a) under a court order, or a request from a law enforcement or other government agency; (b) in connection with efforts to investigate, prevent, or take other action regarding illegal activity, misappropriation, infringements, identity thefts, suspected fraud or other wrongdoing; (c) to protect and defend the rights, property or safety of our Company, our users, our employees; (d) to comply with applicable law or cooperate with law enforcement; (e) to enforce our Terms of Service, Privacy Policy or other agreements or policies; and (f) in connection with the operation of the Service within a different framework, or through another legal structure or entity, or with a substantial corporate transaction, such as the sale of our business, or our Application.

If any third-party rights have been violated (in particular rights relating to copyright, trademarks, names and symbols) by the user, the user data will not be forwarded to the rights holder unless the latter conclusively demonstrates his/her claims to Company.

From time to time, we may ask for your consent to use your information for certain specific reasons. You may withdraw your consent at any time where indicated in the Service or by contacting us at the address provided at the end of this Privacy Policy.

Your email address may be used for the following purposes:

  • - to allow you to register for the Service and to manage and process your registration;
  • - to access your User Account;
  • - service emails (regarding updates, new design, new features, surveys, etc.); and
  • - administrative purposes, such as notification of a violation of our Terms of Service.

 

  1. Cross-border data transfers

Information that we collect and use is normally stored and processed also outside of Europe, for instance in the United States of America and other jurisdictions. The United States, European Economic Area ("EEA") Member States, and other countries all have different laws. When your information is moved from your home country to another country, the laws and rules that protect your personal information in the country to which your information is transferred may be different from those in the country in which you live.

By using the Service, you:

  • - acknowledge and agree that your information will be processed as described in this Privacy Policy; and
  • - consent to having your information transferred to our cooperation partner, affiliates and facilities in the United States or elsewhere or to facilities of third parties with whom we share information as described in this Privacy Policy.

 

  1. How long we store your information

We retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active or as needed to provide the Service to you. We will also retain and use your information to the extent necessary:

  • - to comply with any legal, governmental or regulatory requirement;
  • - to evidence our compliance with applicable law;
  • - for the purposes of fraud prevention and law enforcement;
  • - if there is an outstanding issue, claim or dispute or court order requiring us to keep the relevant information until it is resolved; or
  • - if the information must be kept for our legitimate business interests, such as enforcing our terms or fraud prevention.

When closing your account, be aware that, all your virtual love locks will be irrevocable deleted for you, for your beloved person and from the corresponding bridge, irrespective of your beloved’s consent.

Keep in mind that even though our systems are designed to carry out data deletion processes according to the above guidelines, we cannot promise that all data will be deleted within a specific timeframe due to technical constraints.

Aggregate and/or anonymous information may remain on our servers indefinitely.

 

  1. Children

Our Service is intended for general audiences over the age of 13 years old. If you are based in the EEA you may only use the Service if you are over the age at which you can provide consent to data processing under the laws of your country. The Company does not intentionally collect personal data about children under the age of 13 years old, or under the age of consent to data processing under the laws of countries belonging to EEA. If you are not over 13 years old (or over the age of consent to data processing under the laws of your countries belonging to EEA) then DO NOT DOWNLOAD OR USE THE SERVICE. If you have reason to believe that we may have personal information from or about a child under the age of 13 years old (or under the age of consent to data processing under the laws of resident countries belonging to EEA), please contact us and we will endeavour to remove this information from our databases.

 

  1. Miscellaneous

We take reasonable administrative and technical measures to protect personal data from loss, misuse and unauthorized access, disclosure, modification or destruction. However, there are inherent risks in transmission of information over the Internet or other methods of electronic storage. Therefore, although we strive to protect your data, we cannot guarantee its absolute safety.

We reserve the right to amend our Privacy Policy. Amendments will be effective from the moment of publication, so please check regularly to be sure you are familiar with the latest version.

In the event of a transfer of the Application to a third party, we may transfer to such third party all personal information that we collected about you in accordance with this Privacy Policy. In such an event, the users will be notified when information about those users is transferred and becomes subject to a different Privacy Policy.

This Privacy Policy shall be governed by the laws of Romania and submitted to the exclusive jurisdiction of the courts in Romania.
